Terms of Service

By accessing or using the EL1 Twitch Chatbot platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. EL1 reserves the right to update or modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

EL1 provides a cloud-based Twitch chatbot platform that offers:

• Custom chat commands with variables and cooldowns
• Chat moderation tools (caps, links, spam, emotes, symbols filters)
• Giveaway management with subscriber luck multipliers
• Song request queue management
• Timer-based automated messages
• Integration with third-party services (Discord, Spotify, OBS, Streamlabs, YouTube)
• Badge notification tracking
• Stream overlay tools

To use EL1, you must create an account by connecting your Twitch account via OAuth or registering with an email and password. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

EL1 offers Free, Pro ($4.99/month), Ultra ($9.99/month), and Elite ($14.00/month) subscription plans. By subscribing to a paid plan:

• All subscriptions are billed monthly on a recurring basis
• You authorize EL1 to charge your payment method on a recurring basis
• Prices are in USD and may be subject to applicable taxes
• You may cancel your subscription at any time; access continues until the end of the billing period
• Refunds for subscription plans are available within 14 days of the initial purchase. This subscription refund window applies only to EL1 subscription plans and does not apply to Donations or Tips, which are governed exclusively by Section 05 below and are final and non-refundable
• Downgrades take effect at the end of the current billing period

EL1 provides tools that allow viewers and supporters ("Donors") to send voluntary monetary gifts ("Donations" or "Tips") to streamers and content creators who use the EL1 platform ("Creators" or "Recipients"). The following terms apply to every Donation made through EL1, and by sending a Donation you expressly agree to them:

• Donations are voluntary gifts — not a purchase or a consumer transaction. A Donation is a voluntary, gratuitous, unconditional gift made to support a Creator. It is not a sale or purchase of any goods, services, digital content, subscription, or product, and you receive no goods, services, products, ownership, equity, refundable balance, or any other consideration, benefit, or value in return for a Donation. You expressly acknowledge and agree that a Donation does not qualify as a consumer purchase, e-commerce order, or "Goods and Services" payment, and that consumer-purchase, distance-selling, or buyer-protection rules that apply to the sale of goods or services do not apply to it. Any on-screen alert, message, sound, animation, or acknowledgement triggered by a Donation is a free courtesy only and does not constitute, and shall not be treated as, a purchased good, service, or deliverable.
• Waiver of cooling-off / withdrawal rights. To the fullest extent permitted by law, you expressly waive any statutory cooling-off period, right of withdrawal, or right of cancellation that might otherwise apply, and you request and consent to the Donation being executed and delivered to the Creator immediately, acknowledging that performance begins and completes at the moment the Donation is sent.
• All Donations are FINAL and NON-REFUNDABLE. Once submitted, a Donation is final, irrevocable, and cannot be refunded, reversed, exchanged, credited, cancelled, or returned under any circumstances — including (without limitation) change of mind, dissatisfaction with a Creator or their content, a Creator going offline or ceasing to stream, an alert not displaying, or any unmet expectation. The only exception is a refund that is strictly and unavoidably mandated by applicable law and that cannot lawfully be waived; in that narrow case the refund obligation rests with the receiving Creator and not with EL1, and is limited to the minimum the law requires. You acknowledge that you fully understand and accept this no-refund policy before completing any Donation.
• Waiver of payment-provider buyer / purchase protection. Because a Donation is a gift and not a purchase, you agree not to send Donations as a "Goods and Services" / "purchase protected" payment, and you waive and agree not to invoke any buyer-protection, purchase-protection, or dispute-resolution program offered by any payment provider (including PayPal Buyer Protection) in respect of any Donation. Any such claim is contractually prohibited under Section 06.
• EL1 is an intermediary, not a party to the gift. EL1 only provides the technical platform that facilitates the transfer of a Donation from the Donor to the Creator through a third-party payment processor (for example PayPal or other processors). The Donation is a transaction between the Donor and the receiving Creator. EL1 does not receive, hold ownership of, or become a party to the donated funds, and is not responsible for any dispute, expectation, promise, or arrangement between a Donor and a Creator.
• Eligibility & authorization. By sending a Donation you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), that you are the lawful owner or an authorized user of the payment method used, and that the funds are legitimately yours to give. Donating with a payment method you are not authorized to use, or on behalf of someone who has not consented, is strictly prohibited.
• No reversals or "take-backs". Donations may not be retracted, disputed, or charged back after they are sent. Sending a Donation and later attempting to recover the funds — including through your bank or payment provider — is a breach of these Terms (see Section 06).
• Creator responsibility & taxes. Creators are solely responsible for how Donations they receive are used and for any taxes, fees, or legal obligations that may apply to funds they receive. EL1 does not provide tax, legal, or financial advice.
• Donation limits & review. EL1 may set minimum or maximum Donation amounts, may delay, hold, or decline any Donation, and may withhold or reverse Donations that are suspected to be fraudulent, unauthorized, the result of money laundering, or otherwise in violation of these Terms or the rules of the payment processor.

By proceeding with any Donation, you acknowledge that you have read, understood, and agreed to this entire section and to Section 06, that the Donation is made willingly, knowingly, and irrevocably as a gift with nothing owed or provided in return, and that your action of completing the Donation constitutes your electronic signature and binding consent to these Terms. EL1 and the receiving Creator may retain and rely on a record of this acknowledgement (including date, time, transaction reference, and IP address) as conclusive evidence of your agreement in any dispute or chargeback proceeding.

To protect Creators who rely on Donations as income, the following rules apply to all payments, Donations, and Tips made through EL1:

• Chargebacks are prohibited. Because every Donation is voluntary, final, and non-refundable (see Section 05), you agree not to initiate, request, or threaten a chargeback, payment reversal, or dispute with your bank, card issuer, or payment provider (including PayPal) for any Donation you have made.
• Fraudulent or wrongful chargebacks are a breach of these Terms. Initiating a chargeback after receiving the benefit of a Donation — or as a means of "taking back" a gift you chose to give — constitutes a breach of contract and may also constitute fraud under applicable law.
• Consequences. If you initiate a wrongful chargeback or payment dispute, EL1 may, at its sole discretion: (a) immediately suspend or permanently terminate your account and access to the Service; (b) recover the disputed amount plus any fees, penalties, or charges imposed on EL1 or the Creator by the payment processor as a result of the dispute; (c) pass on or charge you any chargeback / dispute fees incurred; and (d) refer the matter to debt collection or the appropriate authorities where permitted by law.
• Cooperation with processors. EL1 will provide the relevant payment processor with these Terms and evidence of your agreement to them in order to contest any wrongful chargeback. Your acceptance of these Terms and your completion of a Donation serve as your informed consent and proof that the Donation was voluntary and non-refundable.
• Disputes between Donor and Creator. Any disagreement, expectation, or dispute regarding a Donation is solely between the Donor and the Creator. EL1 is not a party to and bears no liability for such disputes and is under no obligation to mediate, refund, or reverse any Donation.
• Subscriptions. For EL1 subscription plans (Section 04), if you believe you were billed in error, please contact support@el1bot.com before opening a dispute so we can resolve it directly.

Ultra and Elite subscribers may use a custom Twitch bot token and bot name. By using this feature:

• You must set the bot account's bio to include: "Managed by EL1 Bot (el1bot.com)"
• You are solely responsible for the bot account and its compliance with Twitch's Terms of Service
• EL1 is not responsible for any actions taken by or against your custom bot account
• Misuse of custom bot tokens may result in immediate account suspension

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Violate Twitch's Terms of Service or Community Guidelines
• Harass, abuse, or harm other users
• Distribute spam, malware, or harmful content
• Attempt to gain unauthorized access to other accounts or systems
• Use automated tools to abuse the Service's API or infrastructure
• Circumvent subscription limits or restrictions
• Resell or redistribute the Service without authorization

All content, features, and functionality of the EL1 platform are owned by EL1 and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of content you create (commands, messages, etc.) but grant EL1 a license to store and process that content as necessary to provide the Service.

EL1 integrates with third-party services (Twitch, Discord, Spotify, etc.). Your use of these integrations is subject to the respective third-party terms. EL1 is not responsible for the availability or functionality of third-party services.

EL1 is provided "AS IS" without warranties of any kind. To the maximum extent permitted by law, EL1 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or profits.

EL1 reserves the right to suspend or terminate your account at any time for violations of these Terms, abuse of the Service, or any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Data may be retained for up to 30 days after termination.

Chat logs and activity data are retained based on your subscription plan:

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any dispute arising under or relating to these Terms (including any Donation) shall be resolved through binding arbitration on an individual basis, and you waive any right to participate in a class or representative action, except where such waiver is prohibited by mandatory law.

Severability. If any provision of these Terms (or any part of it) is held to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed; in either case the remaining provisions shall continue in full force and effect. In particular, if any single sentence of the donation, no-refund, or anti-chargeback terms (Sections 05 and 06) is limited or struck down, the rest of those Sections shall remain fully binding.

Survival. The provisions concerning Donations, no-refund, chargebacks, limitation of liability, intellectual property, and governing law shall survive any termination or expiry of these Terms or of your account.

Entire agreement & no waiver. These Terms constitute the entire agreement regarding the Service and Donations and supersede any prior understanding. EL1's failure to enforce any provision is not a waiver of its right to do so later.
